FLOOR AMENDMENT EXPLANATION
1. Removes the declaration that the regulation of the sale and marketing of tobacco, vapor or alternative nicotine products is a matter of statewide concern and not subject to further regulation by a city, town or county, except as outlined.
2. Removes the preemption of any city, town or county regulation regarding the sale or marketing of tobacco, vapor or alternative nicotine products that is in conflict with or more restrictive than state law or rule and adopted or modified after January 1, 2021.
3. Removes the prohibition on a city, town or county limiting any right granted by Tobacco Sales statutes or rules relating to Tobacco Sales statutes or Licensing and Sale of Alternative Nicotine, Tobacco and Vapor Products statutes.
4. Specifies that the retail tobacco vendor state licensure requirements do not affect a local government's ability to require retail licensure for the sale of tobacco, vapor and alternative nicotine products.
5. Makes conforming changes.
