AN ACT
amending title 13, chapter 31, Arizona Revised Statutes, by adding section 13-3123; relating to firearms.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 13, chapter 31, Arizona Revised Statutes, is amended by adding section 13-3123, to read:
13-3123. Firearms and equipment; lawful possession; unlawful regulation; definition
A. Pursuant to Article II, section 26, constitution of Arizona, the right of a person who is lawfully entitled to retain possession of firearms and equipment may retain possession of firearms and equipment and may use or transport firearms and equipment in this state for any lawful purpose. The right to retain, use or transport firearms and equipment may not be impaired or infringed by the legislature, this state or an agency or political subdivision of this state.
B. A retroactive law that regulates firearms and equipment, including a law that requires an additional or new tax on firearms and equipment that were purchased under a previous law that required only a onetime tax, or mandatory firearms and equipment buyback or registration laws are unlawful and unenforceable.
C. This section does not allow a prohibited possessor to regain the right to possess a firearm.
D. For the purposes of this section, "firearms and equipment" includes:
1. A semiautomatic handgun or revolver that is lawfully possessed by a citizen of this state or that is on the retail market, including a semiautomatic handgun that is configured with any magazine capacity or that is in use by the armed forces of the United States or that is authorized by any law enforcement agency in this state and with any variety of firearm-mounted equipment that is in use by the armed forces of the United States or that is authorized by a law enforcement agency of this state. For the purposes of this paragraph, "Firearm-mounted equipment" includes a threaded barrel, flash-hiding device, sound-dampening device, detachable magazine, aiming system, trigger system and a light.
2. A semiautomatic shotgun, pump-action shotgun, lever-action shotgun or single-shot shotgun that is in any lawful barrel length and that is lawfully possessed by a citizen of this state, that is on the retail market or that is in use by the armed forces of the United States or that is authorized by any law enforcement agency in this state, that is configured with any magazine type or magazine capacity that is in use by the armed forces of the United States or that is authorized by any law enforcement agency in this state and that is configured with any variety of firearm-mounted equipment that is in use by the armed forces of the United States or that is authorized by a law enforcement agency in this state. For the purposes of this paragraph, "Firearm-mounted equipment" includes a threaded barrel, foregrips, detachable magazine, bayonet lug, bayonet, collapsible or folding stock, carrying sling, aiming system, trigger system and a light.
3. A semiautomatic rifle that is in any lawful barrel length and that is lawfully possessed by a citizen of this state, that is on the retail market or is in use by the armed forces of the United States or that is authorized by any law enforcement agency in this state, that is configured with any magazine capacity that is in use by the armed forces of the United States or that is authorized by any law enforcement agency in this state and that is configured with any variety of firearm-mounted equipment that is in use by the armed forces of the United States or that is authorized by a law enforcement agency in this state. For the purposes of this paragraph, "Firearm-mounted equipment" includes a threaded barrel, flash-hiding device, sound-dampening device, pistol grips, vertical foregrips, detachable magazine, bayonet lug, bayonet, collapsible or folding stock, carrying sling, aiming system, trigger system and a light.
4. Any other small arms weapons system, ammunition, accessory or equipment and any component that is used to assemble or reload ammunition, or a cartridge or shell, component, part, tool or device that is used for manufacturing ammunition or the ammunition's components and that is lawfully possessed by a citizen of this state, that is on the retail market or that is in use by the armed forces of the United States or that is authorized for use by a law enforcement agency in this state.
5. Any capacity magazine or ammunition-feeding device and any caliber or gauge or ammunition that is compatible with any of the firearms included in paragraphs 1, 2, 3 and 4 of this subsection, including sufficient quantities of ammunition necessary to maintain a high degree of proficiency of arms and to maintain a ready supply of ammunition.
