Existing law authorizes the State Fire Marshal, among other entities, to seize certain fireworks. Existing law requires the State Fire Marshal to dispose of dangerous fireworks after specified proceedings. Under existing law, if no proceedings are commenced, the State Fire Marshal may dispose of the fireworks after satisfying certain specified requirements.
This bill would require the State Fire Marshal to manage rather than dispose of these fireworks fireworks, as provided, and would eliminate the requirements, including the conditions on disposal, imposed on the State Fire Marshal in the absence of proceedings. The bill would require the State Fire
Marshal to ensure that any dangerous fireworks seized that are identified by the State Fire Marshal as hazardous waste are managed in accordance with California and federal hazardous waste laws and regulations. The bill would require the State Fire Marshal to ensure that this hazardous waste is shipped only by registered hazardous waste transporters and treated, stored, or disposed of only by authorized hazardous waste facilities.
Existing law also requires the State Fire Marshal to acquire and use statewide mobile dangerous fireworks destruction units, as specified.
The bill would eliminate the requirements regarding statewide mobile dangerous fireworks destruction units.
