AN ACT REQUIRING THE DEPARTMENT OF AGRICULTURE TO DOUBLE THE CAPACITY FOR SHELLFISH SAMPLE TESTING AND TO ESTABLISH A SITE FOR SHELLFISH SAMPLE TESTING EAST OF THE CONNECTICUT RIVER.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. Section 26-192b of the general statutes is repealed and the following is substituted in lieu thereof (Effective October 1, 2015):

(a) Notwithstanding the provisions of subsection (a) of section 19a-29a, the Department of Agriculture shall promulgate health standards for shellfish testing and shall approve private laboratories to perform shellfish testing. Such health standards for shellfish testing shall incorporate by reference the provisions of the National Shellfish Sanitation Program Model Ordinance, as amended from time to time.

(b) Not later than October 1, 2017, the Commissioner of Agriculture shall double the number of approved state laboratories to perform shellfish testing required by the Department of Agriculture. Not less than one of such additional laboratories approved pursuant to this subsection shall be located east of the Connecticut River.

This act shall take effect as follows and shall amend the following sections:

To support the expansion of the state's shellfish industry by providing additional facilities for shellfish testing and reducing wait times for the results of such testing.
