HOUSE BILL NO. 222

AN ACT TO AMEND THE CHARTER OF THE TOWN OF BETHEL RELATING TO POLICE.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend the Charter of the Town of Bethel by making deletions as shown by strikethrough as follows:

Section 21: POLICE:

1. The Bethel Town Council has the authority to appoint a police force consisting of a Chief and such number of subordinates as the Council may deem wise; and the Council shall from time to time make rules and regulations as may be necessary for the organization, government and control of the police force.

2. The members of the force shall be subject to the directions of the Council, and may be removed by the Council subject to the provisions of Section 23. They shall preserve peace and order, and shall compel obedience, within the Town limits, of the ordinances of the Town and the laws of the State; and they shall have such other duties as the Council shall from time to time prescribe.

3. Each member of the police force shall be vested, within the Town limits and within one mile outside of said limits with all the powers and authority of a Constable of Sussex County, and may carry firearms, and in case of pursuit of an offender, their power and authority shall extend to any part of the State of Delaware.


SYNOPSIS

This bill removes the one mile radius of the Town limits in which the police force is vested.
