AMENDMENT TO HOUSE BILL 1438
2 AMENDMENT NO. ______. Amend House Bill 1438 by replacing
3everything after the enacting clause with the following:
4 "Section 5. The Life Care Facilities Act is amended by
5adding Section 13 as follows:
6 (210 ILCS 40/13 new)
7 Sec. 13. Continuing Care Retirement Community Transparency
8Task Force.
9 (a) There is created a Continuing Care Retirement Community
10Transparency Task Force consisting of the following members:
11 (1) The Director of Aging, or the Director's designee.
12 (2) The Director of Public Health, or the Director's
13 designee.
14 (3) One member of the House of Representatives
15 appointed by the Speaker of the House of Representatives.
16 (4) One member of the House of Representatives

1 appointed by the Minority Leader of the House of
2 Representatives.
3 (5) One member of the Senate appointed by the President
4 of the Senate.
5 (6) One member of the Senate appointed by the Minority
6 Leader of the Senate.
7 (7) One member from each of the following organizations
8 appointed by the Director of Public Health:
9 (A) 2 representatives selected from
10 recommendations of a statewide organization
11 representing retired people;
12 (B) 2 representatives selected from
13 recommendations of a statewide organization
14 representing Alzheimer's research;
15 (C) 2 representatives selected from
16 recommendations of a statewide organization
17 representing Illinois nursing home communities;
18 (D) One representative selected from
19 recommendations of a senior living facility housing 50
20 residents or more; and
21 (E) One representative selected from
22 recommendations of a senior living facility housing
23 fewer than 50 residents.
24 (b) The Task Force is created to research and collect
25information on transparency and consumer protection issues
26related to life care contracts. The Task Force shall review

1existing legal frameworks to identify all existing consumer
2protections for residents living in continuing care retirement
3communities and all areas in which more consumer protections
4for continuing care retirement community residents are
5necessary. The Task Force shall identify any shortcomings of
6the definition of "life care contract" in Section 2 and
7determine whether that definition should be expanded to include
8more senior living facilities.
9 (c) The members appointed to the Task Force pursuant to
10subsection (a) shall be appointed no later than 30 days after
11the effective date of this amendatory Act of the 101st General
12Assembly.
13 (d) The first meeting of the Task Force shall be no later
14than 30 days after all members of the Task Force have been
15appointed. The members of the Task Force shall receive no
16compensation for their services but may be reimbursed for
17expenses from appropriations made for that purpose.
18 (e) The Department of Public Health shall provide
19administrative and other support to the Task Force.
20 (f) The Task Force shall report its findings to the
21Governor and General Assembly by December 31, 2019.
22 (G) This Section is repealed on January 1, 2020.
23 Section 99. Effective date. This Act takes effect upon
24becoming law.".
