S.F. 2263 DIVISION I 1 FIREARMS, AMMUNITION, OR DANGEROUS WEAPONS —— PUBLICLY 2 ACCESSIBLE PARKING LOTS 3 Section 1. NEW SECTION . 724.4F Dangerous weapons in 4 publicly accessible parking lots. 5 1. A person may carry, transport, or possess a dangerous 6 weapon in a privately owned motor vehicle on the real property 7 comprising a publicly accessible, nonsecure parking lot that 8 is operated by the state or a county, city, or township in the 9 state if the carrying, transportation, or possession of the 10 dangerous weapon is otherwise lawful under the laws of this 11 state and if the dangerous weapon remains out of sight and 12 inside a locked vehicle on the real property when the vehicle 13 is unoccupied. 14 2. This section does not apply to a parking lot at a 15 facility, including an armory, owned or operated by the 16 national guard. 17 3. For purposes of this section, “facility” and “national 18 guard” mean the same as defined in section 29A.1. 19 Sec. 2. EFFECTIVE DATE. This division of this Act, being 20 deemed of immediate importance, takes effect upon enactment. 21 DIVISION II 22 FIREARMS IN VEHICLES TRANSPORTING FOSTER CHILDREN 23 Sec. 3. Section 237.3, Code 2026, is amended by adding the 24 following new subsection: 25 NEW SUBSECTION . 14. Rules of the department shall not 26 prohibit the otherwise lawful carrying, transportation, or 27 possession of a firearm, regardless of whether the firearm is 28 loaded, in motor vehicles used to transport a child in foster 29 care. 30 DIVISION III 31 DANGEROUS WEAPONS IN VEHICLES AT REGENTS UNIVERSITIES AND 32 COMMUNITY COLLEGE CAMPUSES 33 Sec. 4. NEW SECTION . 260C.14B Limitation on authority —— 34 dangerous weapons. 35 -1- LSB 6688XS (2) 91 sb/js 1/ 7
S.F. 2263 The board of directors of a community college shall comply 1 with the requirements of section 724.8C regarding policies and 2 rules relating to the carrying, transportation, or possession 3 of dangerous weapons, as defined in section 702.7, in a 4 personal vehicle on the grounds of the community college. 5 Sec. 5. NEW SECTION . 262.9E Limitation on authority —— 6 dangerous weapons. 7 The state board of regents shall comply with the 8 requirements of section 724.8C regarding policies and rules 9 relating to the carrying, transportation, or possession of 10 dangerous weapons, as defined in section 702.7, in a personal 11 vehicle on the grounds of a university under the control of the 12 state board of regents. 13 Sec. 6. NEW SECTION . 724.8C Limitation on authority —— 14 dangerous weapons —— public universities and community colleges. 15 1. The governing board of a university under the control 16 of the state board of regents as provided in chapter 262 or 17 a community college under the jurisdiction of a board of 18 directors for a merged area as provided in chapter 260C shall 19 not adopt or enforce any policy or rule that prohibits the 20 carrying, transportation, or possession of any dangerous weapon 21 in a locked, personal vehicle on the grounds of such a college 22 or university if the dangerous weapon is not visible from 23 outside of the vehicle and such carrying, transportation, or 24 possession is not otherwise prohibited under this chapter. A 25 governing board of a university or community college shall be 26 immune from any claim, cause of action, or lawsuit by a person 27 seeking damages that are alleged, directly or indirectly, as 28 a result of any concealed dangerous weapon brought onto the 29 grounds of a university or college campus by a person pursuant 30 to this section. 31 2. Subsection 1 does not apply to any of the following: 32 a. A peace officer or other law enforcement officer who is 33 required to carry weapons. 34 b. A person specifically authorized in advance in writing 35 -2- LSB 6688XS (2) 91 sb/js 2/ 7
S.F. 2263 by the president of the university or community college 1 to possess, display, or use a weapon on the university or 2 community college property for a limited purpose consistent 3 with the university’s or community college’s mission. Such 4 purposes include providing campus security, including armed 5 security staff, and the use and storage of weapons as part 6 of the university’s or community college’s criminal justice 7 program or competitive sports shooting program sponsored by the 8 university or community college. 9 c. The possession and use of knives for the purpose of 10 cooking in housing provided or sponsored by the university 11 or college or in the university’s or college’s culinary arts 12 program. 13 DIVISION IV 14 FIREARMS OR OFFENSIVE WEAPONS IN OR NEAR SCHOOLS AND PUBLIC 15 PARKS 16 Sec. 7. Section 724.4A, Code 2026, is amended to read as 17 follows: 18 724.4A Weapons free zones Schools and public parks —— 19 enhanced penalties. 20 1. As used in this section , “weapons free zone” means 21 the area in or on, or within one thousand feet of, the real 22 property comprising a public or private elementary or secondary 23 school, or in or on the real property comprising a public park. 24 A weapons free zone shall not include that portion of a public 25 park designated as a hunting area under section 461A.42 . 26 2. Notwithstanding sections 902.9 and 903.1 , a person who 27 commits a public offense involving a firearm or offensive 28 weapon, within a weapons free zone the area in or on, or within 29 one thousand feet of, the real property comprising a public or 30 private elementary or secondary school, or in or on the real 31 property comprising a public park , in violation of this or any 32 other chapter shall be subject to a fine of twice the maximum 33 amount which that may otherwise be imposed for the public 34 offense. S.F. 2263 public park designated as a hunting area under section 461A.42. 1 DIVISION V 2 WEAPONS ON SCHOOL DISTRICT PROPERTY 3 Sec. 8. Section 724.4B, subsection 2, Code 2026, is amended 4 by adding the following new paragraph: 5 NEW PARAGRAPH . i. A person who has in the person’s 6 possession a valid permit to carry weapons issued pursuant to 7 section 724.7 and remains on the portion of school district 8 property that comprises its driveways and parking lots while 9 going armed with, carrying, or transporting a concealed pistol 10 or revolver. A school shall be immune from any claim, cause 11 of action, or lawsuit by a person seeking damages that are 12 alleged, directly or indirectly, as a result of any concealed 13 pistol or revolver brought onto the school district property by 14 a person pursuant to this paragraph. 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanation’s substance by the members of the general assembly. 18 This bill relates to the carrying, transportation, and 19 possession of weapons by certain persons and in certain 20 locations. The bill is organized by divisions. 21 DIVISION I —— DANGEROUS WEAPONS IN PUBLICLY ACCESSIBLE 22 PARKING LOTS. This division allows a person to carry, possess, 23 or transport a dangerous weapon on the real property comprising 24 a publicly accessible, nonsecure parking lot that is operated 25 by the state or a county, city, or township in the state if 26 the dangerous weapon is out of sight and inside a locked, 27 privately owned vehicle and if the carrying, transportation, or 28 possession of the dangerous weapon is otherwise lawful under 29 the laws of the state. The division does not apply to parking 30 lots at facilities owned or operated by the national guard. 31 A dangerous weapon is any instrument or device designed 32 primarily for use in inflicting death or injury upon a human 33 being or animal, and that is capable of inflicting death upon a 34 human being when used in the manner for which it was designed, 35 -4- LSB 6688XS (2) 91 sb/js 4/ 7
S.F. 2263 except a bow and arrow when possessed and used for hunting or 1 any other lawful purpose. Additionally, any instrument or 2 device of any sort whatsoever that is actually used in such a 3 manner as to indicate that the defendant intends to inflict 4 death or serious injury upon the other, and that, when so 5 used, is capable of inflicting death upon a human being, is 6 a dangerous weapon. Dangerous weapons include but are not 7 limited to any pistol, revolver, or other firearm, dagger, 8 razor, stiletto, switchblade knife, knife having a blade 9 exceeding five inches in length, or any portable device or 10 weapon directing an electric current, impulse, wave, or beam 11 that produces a high-voltage pulse designed to immobilize a 12 person. 13 The division takes take effect upon enactment. 14 DIVISION II —— FIREARMS IN VEHICLES TRANSPORTING FOSTER 15 CHILDREN. This division prohibits the department of health 16 and human services from adopting a rule prohibiting a person 17 from carrying, possessing, or transporting a firearm, 18 regardless of whether the firearm is loaded, in a motor vehicle 19 used to transport a child in foster care if the carrying, 20 transportation, or possession of the firearm is otherwise 21 lawful. 22 DIVISION III —— DANGEROUS WEAPONS IN VEHICLES AT REGENTS 23 UNIVERSITIES AND COMMUNITY COLLEGE CAMPUSES. This division 24 prohibits the governing board of a university under the control 25 of the state board of regents as provided in Code chapter 262 26 or a community college under the jurisdiction of a board of 27 directors for a merged area as provided in Code chapter 260C 28 from adopting or enforcing any policy or rule that prohibits 29 the carrying, transportation, or possession of any dangerous 30 weapon in a locked, personal vehicle on the grounds of such a 31 college or university if the dangerous weapon is not visible 32 from outside of the vehicle and such carrying, transportation, 33 or possession is not otherwise prohibited under Code chapter 34 724. 35 -5- LSB 6688XS (2) 91 sb/js 5/ 7
S.F. 2263 The division does not apply to a peace officer or other 1 law enforcement officer who is required to carry weapons. 2 Additionally, the division does not apply to a person who 3 has been authorized in advance by the president of the 4 university or college to possess, display, or use a weapon on 5 the university’s or college’s property for a limited purpose 6 consistent with the university’s or college’s mission. The 7 division also does not apply to the possession and use of 8 knives for the purpose of cooking in the university’s or 9 college’s culinary arts programs. 10 DIVISION IV —— FIREARMS OR OFFENSIVE WEAPONS IN OR NEAR 11 SCHOOLS AND PUBLIC PARKS. This division relates to public 12 offenses involving a firearm or offensive weapon in and near 13 schools and public parks. 14 Under current Code section 724.4A, the area in or on, or 15 within one thousand feet of, the real property comprising a 16 public or private elementary or secondary school, or in or on 17 the real property comprising a public park, is defined as a 18 “weapons free zone”. A person who commits a public offense 19 involving a firearm or offensive weapon within a weapons free 20 zone is subject to enhanced penalties. 21 The division removes the term “weapons free zone” from Code 22 section 724.4A and makes conforming changes within the Code 23 section. 24 DIVISION V —— WEAPONS ON SCHOOL DISTRICT PROPERTY. This 25 division relates to going armed with, carrying, or transporting 26 weapons on school district property. 27 The division provides that a person who has in the person’s 28 possession a valid nonprofessional permit to carry weapons 29 may go armed with, carry, or transport a concealed pistol 30 or revolver on school district property that comprises its 31 driveways and parking lots. The division provides that a 32 school shall be immune from any claim, cause of action, or 33 lawsuit by a person seeking damages that are alleged, directly 34 or indirectly, as a result of a concealed pistol or revolver 35 -6- LSB 6688XS (2) 91 sb/js 6/ 7
S.F. 2263 brought onto school district property by a person pursuant to 1 the division. 2 A person who goes armed with, carries, or transports a 3 firearm on the grounds of a school in violation of Code section 4 724.4B commits a class “D” felony. A class “D” felony is 5 punishable by confinement for no more than five years and a 6 fine of at least $1,025 but not more than $10,245. 7 -7- LSB 6688XS (2) 91 sb/js 7/ 7
