  1  1    Section 1.  NEW SECTION.  823.1  Short title.
  1  2    This chapter shall be known and may be cited as the "Iowa
  1  3 Fourth Amendment Protection Act".
  1  4    Sec. 2.  NEW SECTION.  823.2  Prohibitions.
  1  5    Notwithstanding any law, regulation, or order to the
  1  6 contrary, an agency of this state, political subdivision
  1  7 of this state, or employee of such an agency or political
  1  8 subdivision acting in the employee's official capacity, or
  1  9 a corporation providing services on behalf of this state
  1 10 or a political subdivision of this state shall not assist,
  1 11 participate with, or provide material support or resources
  1 12 to enable or facilitate, a federal agency in the collection
  1 13 of electronic data or metadata of any person, without that
  1 14 person's informed consent, or without a  warrant, based upon
  1 15 probable cause, that particularly describes the person,
  1 16 place, or thing to be searched or seized, or without acting in
  1 17 accordance with a legally recognized exception to the warrant
  1 18 requirements.
  1 19    Sec. 3.  EFFECTIVE UPON ENACTMENT.  This Act, being deemed of
  1 20 immediate importance, takes effect upon enactment.
  1 21                           EXPLANATION
  1 22 The inclusion of this explanation does not constitute agreement with
  1 23 the explanation's substance by the members of the general assembly.
  1 24    This bill relates to assisting federal agencies in the
  1 25 collection of data or metadata.
  1 26    The bill names the legislation the "Iowa Fourth Amendment
  1 27 Protection Act".
  1 28    The bill prohibits an agency of this state, political
  1 29 subdivision of this state, or employee of an agency or
  1 30 political subdivision acting in the employee's official
  1 31 capacity, or a corporation providing services on behalf of this
  1 32 state or a political subdivision of this state from assisting,
  1 33 participating with, or providing material support or resources
  1 34 to enable or facilitate a federal agency in the collection of
  1 35 electronic data or metadata of any person, without the person's
  2  1 consent, or without a valid warrant based upon probable cause.
  2  2    The bill takes effect upon enactment.
