H.F. 129 Section 1. NEW SECTION . 724.26A Sale, transfer, or 1 possession of large capacity ammunition feeding devices —— 2 penalty. 3 1. For purposes of this section, a “large ammunition feeding 4 device” means a magazine, belt, drum, or similar device that has 5 a capacity of, or that can be readily restored or converted to 6 accept, more than ten rounds of ammunition. 7 2. A person who sells, transfers, or possesses any large 8 capacity ammunition feeding device commits an aggravated 9 misdemeanor. 10 Sec. 2. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 11 immediate importance, takes effect upon enactment. 12 Sec. 3. APPLICABILITY. This Act applies to any large 13 capacity ammunition feeding device sold, transferred, or 14 possessed on or after the effective date of this Act. 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanation’s substance by the members of the general assembly. 18 This bill prohibits the sale, transfer, or possession of 19 large capacity ammunition feeding devices, provides a penalty, 20 and includes effective date and applicability provisions. 21 The bill provides that a person who sells, transfers, or 22 possesses any large capacity ammunition feeding device commits 23 an aggravated misdemeanor, punishable by confinement for no 24 more than two years and a fine of at least $855 but not more 25 than $8,540. Under the bill, a “large ammunition feeding 26 device” means a magazine, belt, drum, or similar device that 27 has a capacity of, or that can be readily restored or converted 28 to accept, more than 10 rounds of ammunition. 29 The bill takes effect upon enactment and applies to any 30 large capacity ammunition feeding device sold, transferred, or 31 possessed on or after the effective date. 32 -1- LSB 1626YH (3) 89 js/rh 1/ 1
