STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty-Six

 

AN ACT enabling the carrying of a firearm on an OHRV when such OHRV is being operated on private property.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Loaded Firearms Forbidden.  Amend RSA 215-A:20 to read as follows:

215-A:20 Loaded Firearms Forbidden.

No person shall carry on an OHRV, or a trailer towed by same, any firearms unless said firearm is unloaded. This section shall not apply to law enforcement officers carrying firearms in the course of duty, or to pistols or revolvers carried by any person who is not prohibited from possessing a firearm by a New Hampshire statute. This section shall not apply when the OHRV is being operated on private property where the operator has the express or implied permission or license of the landowner or lawful occupant to be present, provided that such permission does not arise solely by way of a public right-of-way, public trail, or designated OHRV trail/corridor. For the purposes of this section, “unloaded” shall mean that the firearm is not loaded as defined in RSA 207:1, XIV-a. A firearm shall not be considered to be loaded merely because a magazine, tube, or other ammunition storage device attached to the firearm contains ammunition, so long as no round is chambered.

2  Effective Date.  This act shall take effect January 1, 2027.
