STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty-Six
A RESOLUTION reaffirming the right for persons of all persuasions to keep and bear arms, and urging Congress and the President to cease infringement upon Second Amendment rights and to restore them where infringed.
Whereas, the Second Amendment to the United States Constitution declares that “the right of the people to keep and bear arms shall not be infringed”; and
Whereas, part I, article 2-a of the New Hampshire constitution affirms that “all persons have the right to keep and bear arms in defense of themselves, their families, their property and the state”; and
Whereas, these protections are broad, natural rights, belonging equally to every United States citizen, not privileges to be granted or denied by the federal government on the basis of sexual or religious orientations and preferences or other collective classifications; and
Whereas, recent reports indicate that the U.S. Department of Justice has held internal discussions about a potential rule that could restrict entire groups of Americans, defined by their sexual orientation or expressed gender, from owning firearms, thereby denying them the full enjoyment of their second amendment rights, an action that would carve out classes of Americans to be treated unequally under the constitution; and
Whereas, selective denial of constitutional rights undermines equal protection under the law and sets a dangerous precedent, to wit, that if the rights of one group may be stripped by government, the rights of all are endangered; and
Whereas, the federal government has further failed to advance corrective legislation such as the Stop Harassing Owners of Rifles Today (SHORT) Act, leaving in place unconstitutional restrictions on firearms and accessories in common use; and
Whereas, the accumulation of such regulatory and legal infringements erodes public trust in our society and imperils the rights of law-abiding citizens in New Hampshire and across the United States; now, therefore, be it
Resolved by the House of Representatives:
That the New Hampshire general court does hereby reaffirm its unqualified support for the Second Amendment to the United States Constitution and Part I, Article 2-a of the New Hampshire constitution; and
That we call upon our United States Senators and Representatives not only to oppose any and all federal measures that would infringe upon the right of the people to keep and bear arms, including any attempt by the Department of Justice to deny these rights selectively to classes of citizens based on sexual orientation, religion, or other broad classification, and to oppose the continued failure of Congress to pass protective legislation such as the SHORT Act, but also to work affirmatively to restore rights that have already been infringed; and
That copies of this resolution be transmitted by the house clerk to the President of the United States, the Speaker of the United States House of Representatives, the Majority Leader of the United States Senate, and to each member of New Hampshire’s congressional delegation.
