       AN  ACT  authorizing  a study by the New York state division of criminal
         justice services to study the treatment of  aging  prison  populations
         and  make  recommendations for ensuring humane treatment of such popu-
         lations
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The division of criminal justice services shall undertake a
    2  study  of the treatment, conditions and prevalence of aging prison popu-
    3  lations and issue recommendations appertaining to such populations.  The
    4  study shall analyze no fewer than the following issues:
    5    (a) factors contributing to the growth in the number and proportion of
    6  elderly inmates;
    7    (b) whether, and to what extent, older prison  populations  are  being
    8  provided  with adequate housing, medical care, and programs that respond
    9  to their unique needs and vulnerabilities;
   10    (c) provision of specialized training for corrections officers working
   11  with older inmates;
   12    (d) assigning oversight of older inmates to a specific official within
   13  each correctional facility.
   14    S 2. The division of criminal justice services shall make a report  to
   15  the governor and the legislature of its findings, conclusions and recom-
   16  mendations  no  later than one year after the effective date of this act
   17  and shall submit with its report such legislative proposals as it  deems
   18  necessary to implement its recommendations.
   19    S  3. To the maximum extent feasible, the division of criminal justice
   20  services shall be entitled to request and receive and shall utilize  and
   21  be  provided  with  such  facilities,  resources  and data of any court,
   22  department, division, board, bureau, commission or agency of  the  state
   23  or  any  political  subdivision  thereof as it may reasonably request to
   24  carry out properly its responsibilities pursuant to this act.
   25    S 4. This act shall take effect immediately.
