Paragraphs b, c, d, e, f and g of subdivision 7 of section 2 11-0903 of the environmental conservation law are relettered paragraphs 3 c, d, e, f, g and h. 4 S 2. Paragraphs a, c and h of subdivision 7 of section 11-0903 of the 5 environmental conservation law, paragraph c as amended by section 35 of 6 part F of chapter 82 of the laws of 2002 and as relettered by section 7 one of this act, paragraph h as amended by chapter 143 of the laws of 8 1982 and as relettered by section one of this act, and such subdivision 9 as renumbered by chapter 911 of the laws of 1990, are amended to read as 10 follows: 11 a. [Such] IN WESTCHESTER COUNTY, SUCH season shall not include Satur- 12 days or Sundays [and]; 13 B. SUCH SEASON shall not commence earlier than during the first full 14 week in January nor shall it continue later than January 31 in any year; 15 c. Deer may be taken only by holders of a license authorizing the 16 taking of big game who have also obtained a special permit provided by 17 the department and issued by the town clerk of each town where such 18 season is fixed; PROVIDED, HOWEVER, A TOWN MAY, BY LOCAL LAW, WAIVE THE EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD13838-04-4 S. 6630--A 2 A. 8822--A 1 REQUIREMENTS THAT A PERMIT IS NECESSARY TO TAKE DEER DURING SUCH 2 SEASONS; 3 h. Such a season shall be fixed only in towns or parts thereof where 4 the discharge of firearms is not prohibited by town ordinance, and deer 5 shall be taken only by means of shotguns using a single ball or slug or 6 muzzle loading firearms[;], PROVIDED, HOWEVER THAT A DEER MAY ALSO BE 7 TAKEN BY LONG BOW IN SUFFOLK COUNTY. 8 S 3. a. Any local law authorizing a town to waive the requirement 9 that a permit is necessary to take deer pursuant to subdivision 7 of 10 section 11-0903 of the environmental conservation law must be passed by 11 the local legislature prior to June first and shall apply to all open 12 seasons established pursuant to such subdivision that commence after 13 such passage until such local law is repealed. 14 b. Any town that waives the permit requirements of subdivision 7 of 15 section 11-0903 of the environmental conservation law shall notify the 16 department of the passage of the local law authorizing such action by 17 the town on the same date that the town sends notification of the final 18 adoption of such local law to the department of state pursuant to 19 section 27 of the municipal home rule law. 20 S 4. This act shall take effect immediately.
