                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Creates crime of threatening a public official. Punishes by
maximum of 10 years' imprisonment, $250,000 fine, or both.
  Declares emergency, effective on passage.

                        A BILL FOR AN ACT
Relating to crime; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) A person commits the crime of threatening a
public official if:
  (a) The person makes a threat of imminent serious physical
injury or death to a public official serving in a state or
federal elective office, or a threat of imminent serious physical
injury or death to a family member of a public official serving
in a state or federal elective office;
  (b) The person knew or should have known that the person to
whom the threat was made was a public official serving in a state
or federal elective office, or to a family member of a public
official serving in a state or federal elective office; and
  (c) The threat was made in such a manner and under such
circumstances that the public official or family member has a
reasonable fear for the personal safety of the public official or
family member.
  (2) A threat under this section may be written, may be made by
telephone or may be an electronic threat as defined in ORS
166.065.
  (3) Except as provided in subsection (4) of this section,
threatening a public official is a Class C felony.
  (4) Threatening a public official is a Class B felony if a
person violates subsection (1) of this section while displaying a
firearm or other deadly weapon to the public official or family
member of the public official.
  (5) As used in this section, 'family member' means any person
related by consanguinity or affinity within the second degree and
includes a domestic partner or household member. + }
  SECTION 2.  { + This 2013 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2013 Act takes effect on its
passage. + }
